Home > Legal Advice > Common Problems

In case somebody does not have a birth certificate, or wishes to procure one one has to do the following :

1.

Where the Application has to be made

A birth certificate is issued by the local self governing body (a Gram Panchayat, Municipality or Municipal Corporation) or its successor, in whose area were you born. In case of larger cities, you shall have to apply to the ward office in whose area you were born.

To obtain the certificate you have to make an application, either on the available prescribed form or on plain paper, giving details of your parents names, the place, date and time of birth, and the certificate is issued to you in due course of time, in case you were born in any hospital, and your birth has been thus automatically registered, or if your birth has been registered even otherwise.

In case your birth is not registered, and you were born at home, you shall have to follow the procedure prescribed by the authorities, which may include filing of affidavit etc., and a permission from the Assistant Collector / District Collector, before such certificate is issued to you.
