If somebody other than Deccan Herald registers the domain name www.deccanherald.com, or registers a deliberately mis-spelt variant like www.decanhereld.com, without having any legitimate interest in that name, would it be a case of cyber-squatting? What is the remedy for Cyber Squatting in India if somebody other than Deccan Herald registers the domain name www.deccanherald.com and publishes his business contents on the www.deccanherald.com which would be similar or same to the business of www.deccanherald.com without having any legitimate interest in that name since the Information Technology Act 2000 is silent on Cyber Squatting ? Can the Deccan Herald prosecute the Cyber Squatter in the District Court in above mentioned scenario under I.T Act 2000? Note: Deccan Herald's domain name used here is for better understanding instead of using the hypothetical domain name.
